General Terms & Conditions of Organized Travel Packages

Please read carefully the present General Terms & Conditions, which constitute an integral part of every organized travel package contract offered by Genius Travel.
Participation in any organized travel package presupposes careful review of the relevant program and implies full and unconditional acceptance of the present Terms, in accordance with Presidential Decree 7/2018 and Directive (EU) 2015/2302.
The specific details of each travel package (destinations, prices, services, departure and return times, etc.) are described in the respective program and price list, which apply in conjunction with the present Terms.

  1. Organizer

Our company, operating under the corporate name “TZINIOUS TRAVEL Single Member Private Company (IKE)” and the trade name “Genius Travel”, having its registered office in Thessaloniki, 7 Odysseos Street, M.H.T.E. No. 0933E60000241200, telephone +30 2312 313519, email info@travelgenius.gr, hereinafter referred to as the “Tour Operator”, acts as an organizer of travel packages either independently or in cooperation with other travel agencies, or as an intermediary between travel agencies and transport providers, with the ultimate purpose of selling organized travel packages to travelers.

  1. General Information

The information, data and recommendations contained in these General Terms have been reviewed by our office for their validity and accuracy and apply as stated, unless otherwise specified in the program of a particular trip.
Travel programs, including the applicable price list, are valid for the period stated therein. Information and details may be subject to change due to extraordinary circumstances. In such cases, travelers will be informed promptly by the most appropriate means, provided that accurate contact details have been supplied, for which the traveler bears sole responsibility.
Any special wishes, needs or requirements relating to the trip must be expressly included in the contract, provided that they have been agreed upon and are feasible.

  1. Registrations – Participation in Organized Travel Packages

Registrations may be made by visiting our offices or those of our partners, by correspondence, telephone, or through our official website, subject to payment of the required amount in order to secure participation. Payment may be made in cash, by credit/debit or prepaid card, or by bank transfer to the Tour Operator, and automatically implies full acceptance of the present Terms.
Participation in the trip is secured upon payment of the required deposit, adherence to the agreed payment schedule, and full settlement of the travel cost and any applicable surcharges no later than fourteen (14) days prior to departure for trips within Greece and abroad, and thirty (30) days prior to departure for long-haul trips and trips to the Russian Federation, unless otherwise specified in the relevant contract.
Failure to complete payment within the prescribed timeframe entitles the Tour Operator to cancel the booking and possibly apply cancellation fees in accordance with the present Terms.
The contracting party representing a family or group is obliged to inform all participants of the travel details and conditions. Participants registered through a third party bear the same obligations as the registering representative.
The travel services provided and the related costs are detailed in the Organized Travel Contract to be signed. In cases where physical presence is not possible (e.g. telephone or email booking), the contract will be sent electronically. In such cases, the traveler has the right to withdraw from the contract within fourteen (14) days from receipt, subject to the applicable cancellation charges described in Article 11.
For organized air travel packages, the tour leader will be present at the arrival airport. Services commence and conclude upon arrival at and departure from the destination airport respectively. The Tour Operator reserves the right to replace the tour leader during the trip. In certain cases, escort services may be provided by local representatives.
The Tour Operator bears no responsibility for the operating days and hours of markets, museums, archaeological sites, etc.
For the provision of requested travel services, the Tour Operator processes Personal Data provided by the traveler, in accordance with the General Data Protection Regulation (GDPR), for a reasonable period of time.

  1. Travel Prices – Surcharges

Travel prices are stated in the applicable price list and are calculated based on service costs, fuel or energy costs, applicable fares and surcharges, taxes or fees, currency exchange rates against the Euro (€), and other cost factors.
The Tour Operator reserves the right to adjust prices if these factors change. Price adjustments may occur up to twenty (20) days prior to the commencement of travel services and will be communicated clearly and analytically.
In the event of a significant price increase exceeding 8% of the total travel cost, the traveler may terminate the contract without termination charges and receive a full refund. Alternatively, the traveler may accept an equivalent or higher-quality package. The traveler must notify the Tour Operator in writing within three (3) days of being informed of the increase.
Travel prices do not include costs related to travel documents or medical examinations required by national or EU regulations. Such costs are borne exclusively by the traveler.
The Tour Operator may offer promotional prices for a limited period or number of seats, subject to special cancellation terms.
Child pricing varies depending on the offer and usually applies to children aged 2–12 sharing a room with two adults.
Local accommodation taxes, climate crisis fees, or similar charges are not usually included and are payable directly at the accommodation.

  1. Obligations – Responsibilities of the Tour Operator

The Tour Operator is responsible for coordinating and executing travel packages to the best possible standard. However, it bears no responsibility for acts or omissions of third parties, collaborators, or extraordinary circumstances such as delays, cancellations, route changes, strikes, embargoes, or force majeure events.
The Tour Operator cannot predict or control delays of chartered or scheduled transport for technical, meteorological, or other reasons. Travelers are advised not to schedule critical personal activities on arrival or departure days.
In cases of force majeure or unavoidable extraordinary circumstances, the Tour Operator bears no liability for damages but will make every reasonable effort to assist travelers. Any additional expenses incurred are borne by the travelers themselves.
Complaints during the trip must be reported immediately, in writing, to the tour leader or service provider. Written complaints must be submitted within seven (7) working days after return, accompanied by supporting documentation. After this period, the Tour Operator has no obligation to respond.
Compensation for non-performance or improper performance of services is limited to twice the per-person travel price, in accordance with applicable international conventions.
The Tour Operator reserves the right to cancel trips due to force majeure or insufficient participation. Minimum participation is 20 persons (excluding children under 12), or 15 persons for long-haul trips, unless otherwise stated.

  1. Obligations – Responsibilities of Travelers

Travelers must behave appropriately, comply with the travel program and instructions of guides, and arrive punctually at meeting points. Delays resulting in missed services are the traveler’s sole responsibility and expense.
Travelers must be present at airports and ports at least two (2) hours before departure.
Travelers who voluntarily leave the group are not entitled to refunds or compensation.
Travel reservations may be transferred to another eligible person up to seven (7) days prior to departure (ten (10) working days for sea transport), subject to acceptance by all service providers. Both parties are jointly liable for any outstanding amounts.
Photographic or audiovisual material may be recorded during the trip and used for promotional purposes by Genius Travel, unless the traveler explicitly objects at the time.
If a trip is interrupted due to quarantine, hospitalization, or public health measures, Genius Travel bears no liability for unprovided services or compensation.

  1. Hotels – Accommodation – Transport

Hotel classifications follow local regulations and may differ between countries. Check-in and check-out times are determined by hotel policy.
In cases of overbooking, accommodation may be replaced with equal or lower category accommodation, with refund of any price difference.
Seat allocation on coaches is determined by booking order for domestic trips and rotates daily on international trips. Smoking on coaches is prohibited.
The Tour Operator is not responsible for personal belongings. Travelers are advised to safeguard valuables.

  1. Passports, Visas & Health Requirements

Travelers are responsible for ensuring the validity and safekeeping of travel documents. The Tour Operator provides general information but bears no responsibility for document issuance or visa approval.
Health regulations, vaccinations and medical precautions are the sole responsibility of the traveler. Travelers with medical conditions must consult their physician prior to travel.

  1. Insurance

The Tour Operator maintains professional civil liability insurance covering organizer insolvency.
Travel insurance covering accidents, medical expenses, baggage loss, repatriation, etc. is provided for travelers up to 75 years of age. Limited coverage applies for travelers over 75. Optional additional insurance is strongly recommended.

  1. Luggage

Luggage is transported under the responsibility of the traveler. Airline baggage limits apply, and excess baggage charges are payable directly by the traveler. In case of loss or damage, applicable international conventions apply.

 
 
  1. Cancellation Policy

Cancellations must be submitted in writing and are subject to cancellation fees depending on the timing of cancellation, as detailed in the applicable travel program.
Cancellation fees may reach 100% of the travel cost, particularly for non-refundable fares or special travel periods.

  1. Dispute Resolution

The parties agree to resolve disputes amicably and in good faith. If amicable resolution fails, disputes shall be submitted to the Friendly Dispute Resolution Committee of the Hellenic Association of Travel & Tourist Agencies.
If no resolution is achieved, the courts of Thessaloniki, Greece shall have exclusive jurisdiction.
